In this policy, we inform you, pursuant to Art. 13 and 14 of the General Data Protection Regulation ("GDPR"), about the processing of your personal data when you visit the website https://www.ballarino-amplification.com (the "Website") and when you conclude a contract via the Web

  1. Controller for Data Processing 
    The Controller, as defined by the GDPR, is p3 GmbH, with its business address at Grillenbergstr. 4, 4407 Dietach, Austria, E-mail: office@ballarino-amplification.com (hereinafter referred to as "we" or "us").
  2. Data Processing When Visiting the Website (Server Log Files)  
    Each time you access our Website, our system automatically collects data and information from the computer system of the accessing computer/device. This data is technically necessary to display the Website to you and to ensure its stability and security. Processed Data: IP address (anonymized or stored for a short term), date and time of access, browser type and version, operating system used. Legal Basis: This is technically necessary to display the Website as requested by you and to conclude contracts with you (Art. 6 no. 1 lit b) GDPR). Recipients: This data is processed by our hosting provider. Our provider's servers are located in Germany (EU). A Data Processing Agreement (DPA) pursuant to Art. 28 GDPR is in place. Storage Period: We delete the data once its storage is no longer necessary
  3. Cookies, Tracking, and Analysis Tools 
    We do not use any tracking technologies, marketing cookies, or analysis tools (such as Google Analytics, Matomo, etc.). No tracking of your user behavior takes place. This website exclusively uses technically necessary "cookies" (small text files automatically created by your browser and stored on your device) insofar as they are strictly required to ensure the proper operation of the web-shop and the processing of your purchase (e.g. storing items in the shopping cart during your visit and ensuring the functionality of the checkout process and order processing). Essential functions cannot be provided without these cookies. Legal Basis: The processing of this data is based on Art. 6 no. 1 lit. f) GDPR (legitimate interest in the functional provision of our online services) as well as for the implementation of pre-contractual measures or the performance of a contract pursuant to Art. 6 no. 1 li. b) GDPR (shopping cart function). Cookie Management: You can configure your browser so that no cookies are stored on your computer or so that a prompt appears before a new cookie is created. However, the complete deactivation of cookies may result in you being unable to use the functions of our web-shop (specifically the shopping cart and checkout). Storage Period: Depending on your browser. Clearing the browser cache removes any cookies set by us.
  4. Data Processing When Contacting Us 
    If you contact us via e-mail or the contact form, the data you transmit (e.g., e-mail address, name, content of your inquiry) will be stored to process your request. Legal Basis: The processing is necessary for the implementation of pre-contractual measures or to answer your inquiry (Art. 6 no. 1 lit b) GDPR), or it is based on our legitimate interest in responding (Art. 6 no. 1 lit. f) GDPR). Storage Period: We delete the data once its storage is no longer necessary.
  5. Data Processing for Contract Performance (Orders) 
    If you place an order in our shop, we process the data necessary for the conclusion and performance of the purchase agreement. Processed Data: First and last name, shipping and billing address, e-mail address, order data, payment data. Legal Basis: The processing is necessary for the performance of a contract or for the implementation of pre-contractual measures (Art. 6 no. 1 lit b) GDPR). Storage Period: Due to tax and commercial law requirements (in particular § 132 BAO [Austrian Federal Fiscal Code], § 212 UGB [Austrian Commercial Code]), we are obliged to retain invoice data for a period of seven years.
  6. Data Processing for Newsletters and Direct Marketing
    We may use your email address to send you information and offers as a means of Direct Marketing to existing customers: If you have provided your email address in the context of a purchase in our web shop, we reserve the right to send you offers for similar goods from our range via email from time to time. This takes place on the basis of our legitimate interest in direct marketing (Art. 6 no. 1 lit. f) GDPR in conjunction with Sec. 174 para. 4 Austrian Telecommunications Act 2021 - TKG 2021), provided you have not objected to this use by unsubscribing. The sending of these Direct Marketing mails is done via our own mail server, no external service is used. You can unsubscribe from the newsletter at any time and object to the use of your email address. For unsubscribing you will find a corresponding unsubscribe link at the bottom of every email. Alternatively, you can send your unsubscribe request to the contact address given in the Legal Notice (Imprint) at any time.
  7. Data Transfer to Third Parties (Payment and Shipping) 
    1. Payment Service Providers: Depending on the payment method selected, we forward the necessary payment data to the payment payment service provider commissioned by us. For the processing and orchestration of payment transactions, we have commissioned the service providers: Mollie B.V., Keizersgracht 126, 1015CW, Amsterdam, Netherlands, which acts as a Processor and whose privacy policy can be viewed here: https://www.mollie.com/at/legal/privacy
    2. Shipping Providers: For the purpose of delivering the goods, we pass on your address data and, if applicable, your e-mail address or telephone number (only for the purpose of shipment notification or coordination) to the commissioned shipping company (e.g., Österreichische Post AG, UPS, FedEx, ...). For the worldwide processing of shipping arrangements and delivery, we have commissioned the service provider Sendcloud GmbH, Fürstenrieder Str. 70, 80686 Munich, Germany, which acts as a Processor and whose privacy policy can be viewed here: https://www.sendcloud.com/privacy-policy/.
  8. Data Transfer to Third Countries (Worldwide Shipping) 
    Our hosting takes place exclusively within the EU (Germany). If you order a delivery to a country outside the European Union (Third Country), the transmission of your address data (name, address) to the local postal or customs authorities is mandatory. Legal Basis: This transfer is necessary for the performance of the purchase agreement with you (Art. 49 no. 1 lit. b) GDPR). We point out that in some third countries (e.g., the USA), there is no level of data protection equivalent to that of the EU (no adequacy decision).
  9. Data Security 
    We secure our Website and other systems through technical and organizational measures (TOMs) against loss, destruction, access, modification, or dissemination of your data by unauthorized persons. Data transmission (e.g., during the order process) is carried out using SSL/TLS encryption.
  10. No Automated Individual Decision-Making 
    We do not use automated individual decision-making or profiling (Art. 22 GDPR).
